
Cross the Ball Membership Terms
The following is the Cross the Ball Membership Agreement between Response Gaming Limited (“we and us”) and the person whose name appears on the account and/or welcome email/letter (“you”).
YOU ARE URGED TO READ THE TERMS OF CROSS THE BALL MEMBERSHIP AND MEMBERSHIP AGREEMENT CAREFULLY AND TO COMMUNICATE ANY QUESTIONS THAT MAY ARISE REGARDING YOUR MEMBERSHIP TO OUR CUSTOMER CARE TEAM ON 0333 202 0651, 10.00AM to 4.00PM MONDAY to THURSDAY (EXC. BANK HOLIDAYS).
Cross the Ball is available to Great Britain Residents aged 18 or over and who are legally able of entering a binding contract. Cross the Ball Membership is void where prohibited by law.
Cross the Ball Membership: As a Cross the Ball Member, you will receive 4 weekly games every 28 days.
Cross the Ball Trial Period: You may have been offered a trial of a Cross the Ball membership (“Trial Period”). You may cancel your membership at any time within this Trial Period. If you request to cancel, you will not receive any further magazines or incur any further charges.
Cross the Ball Membership Term: Cross the Ball Memberships will be billed at £4.95 per week and billed in 4 weekly increments every 28 days.
Renewal of Cross the Ball Membership: Your membership will automatically renew unless you notify us that you wish to terminate this agreement and cancel your Cross the Ball Membership by calling 0333 202 0651, in writing or emailing support@crosstheball.co.uk. A cancellation request must be received before the request to bill has occurred to avoid any additional charges. You are not eligible for a refund if you do not cancel before the beginning of a new membership period (unless the magazine pack is returned to us in its original state and packaging within 28 days of the dispatch date and has not been tampered with, defaced or destroyed in anyway; see Refund & Returns Policy below for full details).
Payment of Membership Fee: The payment of your Membership Fee is charged automatically as authorised by you, when you agreed to your Cross the Ball membership. We reserve the right to increase or decrease the membership fee for each renewal term effective upon renewal of your Cross the Ball Membership. We will notify you of any changes 30 days in advance.
Collecting Payments: If there is an issue with collecting payment using the details securely passed to us following your agreement to join Cross the Ball, we may try again several times for a period of up to, or beyond seven (7) days from due date. The date we retrieve these funds will not affect your future billing dates. If we are unable to bill your specified billing source, you agree to provide an alternative billing source and we will contact you to arrange this. We have the right to share your details securely with a third party to retrieve your billing information or reattempt your billing details. If you are not up to date on your payments, we have the right to withdraw or restrict your membership. If you fail to pay your Cross the Ball Membership fee, either through the authorised billing source, or any alternative means within thirty (45) days of the fee being due, then we shall have the right to terminate your Cross the Ball Membership.
Active Member: You are deemed an “Active” Cross the Ball Member immediately upon successful registration and until a renewal payment is unpaid or a request to cancel immediately has been actioned.
Additional Member Offers: Cross the Ball Active Members will be eligible for ongoing and additional benefits as part of their membership. You may, on occasion, be introduced to Exclusive offers by us.
Additional Terms & Conditions: Some parts of your membership may have additional specific terms over and above those laid out in this agreement. Please refer to your magazine for full details of any additional terms.
Prizes: To be eligible to enter each Cross the Ball game and claim prizes you must follow all instructions for each weekly game, be an Active Cross the Ball Member and be up to date with your payments. You will be notified by phone, email or post if you have won a prize.
Publicity: As an Active Cross the Ball Member you agree that we can use your name and county for advertising and publicity purposes without further consent. If you are a winner, we may from time to time ask you for a picture of yourself. If you agree, any picture we take of you or you send to us can be used for advertising and publicity purposes without further consent. You have the right to change your mind at a later date and in this instance simply contact us by post, email or telephone and we will cease using your details or image.
Disclaimer of Liability: You agree that we are not responsible or liable for late delivery of the Cross the Ball games.
Cancellation Policy: You will not incur any fees to cancel your account. If you have a Trial offer you can cancel your Membership at any time within the Trial Period. Where possible, please contact us between 10am – 4pm, Monday – Thursday and before the payment renewal date to avoid being charged. Cancellations outside of the Trial Period must be made within the above opening hours and before the payment renewal date to avoid being charged. You must request to cancel your membership by Phone by calling 0333 202 0651.
Once cancelled you can still enter any Cross the Ball games you have already paid for and received.
You are not entitled to a refund on any fee or payment for any Cross the Ball games that have already been dispatched (unless the games are returned to us in their original state and packaging within 28 days of the dispatch date and has not been tampered with, defaced or destroyed in anyway; see Refund & Returns Policy below for full details).
We reserve the right to cancel a player's membership at anytime and for any reason. Already paid for games will be dispatched as usual or where this is not possible a full refund of undelivered games will be issued.
Refund & Returns Policy: All fees and payments are non-refundable unless the games are returned to us in their original state and packaging within 28 days of the dispatch date and has not been tampered with, defaced or destroyed in anyway. After this 28-day period, no prior payments will be refunded.
Entire Agreement: This Agreement contains all the Terms of Cross the Ball Membership and warranties, representations, terms, conditions, inducements, promises or agreements concerning the Cross the Ball Membership and unless expressly included in this Agreement they shall not form part of this Agreement or have any force or effect. If any of the terms of this Agreement shall become invalid or unenforceable, the remaining terms shall not be affected.
Governing Law: This Agreement and the Terms of the Cross the Ball Membership shall be governed and construed in accordance with English law, and both you and us accept the exclusive jurisdiction of the English courts.
Reservation of Rights: We reserve the right to change the terms and conditions of this Agreement and any Cross the Ball Membership policies at any time without prior notice.
Data Protection: Your personal details will be held by us and used by us for Cross the Ball Membership administration. Further details can be found within our Privacy Policy. By becoming a Cross the Ball Member you expressly consent to this.
Reservation of Rights: We reserve the right to eliminate, add, change and substitute prizes and rewards without notice. We further reserve the right to change the terms and conditions of this agreement and any Cross the Ball Membership policies at any time without prior notice.
Cross the Ball Complaints Procedure: If you wish to lodge a complaint about any part of your membership please do so in writing to: Response Gaming Complaints, Business & Innovation Centre, Enterprise Park East, Sunderland, SR5 2TA.
